A Supplement Facts panel on a CBD tincture carton is the wrong panel. FDA concluded on January 26, 2023 that it doesn’t intend to allow CBD in dietary supplements or conventional foods. It denied three citizen petitions that asked for exactly that outcome. A carton designed as if the product were a supplement is describing a category the product is not permitted to occupy.

What Did FDA Actually Decide About CBD?

FDA said it is not apparent how CBD products could meet the safety standards for dietary supplements or food additives. It then stated that it does not intend to pursue rulemaking allowing the use of CBD in dietary supplements or conventional foods.

The agency added that it would continue to take action against CBD products, and that it would work with Congress on a new regulatory pathway. That pathway hasn’t arrived and the January 2023 position still stands.

What Does That Mean for the Carton?

It means the panel structure of a supplement does not belong on a tincture box.

Why Is a Tincture Carton Tighter Than a Dropper Carton?

Because a tincture is an extract in alcohol or glycerin, and the bottle carries a dosing scale on the dropper in most ranges. That dropper assembly adds height a catalog figure leaves out.

Can I put a Supplement Facts panel on a CBD tincture box?

Not while FDA's January 2023 position stands, and it still does. The agency stated it doesn't intend to allow CBD in dietary supplements or conventional foods and it denied three petitions asking for that. A Supplement Facts panel presents the product as something FDA has said it cannot lawfully be. Check your final panel wording with your own regulatory advisor.

What has to be printed on a CBD tincture box?

You need a statement of identity and the net contents and the full ingredient list and your name and place of business. Net contents belong in the bottom 30 percent of the front panel. A batch or lot number belongs on the carton as well so a certificate of analysis can be matched to the bottle in hand.

What is the difference between a CBD oil box and a tincture box?

The bottle format is the same and the difference sits in the carrier and the label. A tincture is an extract in alcohol or glycerin and it ships with a dosing scale on the dropper in most ranges. Does the new federal hemp definition affect tinctures?

Yes, and the date is November 12, 2026, when a finished hemp product is limited to 0.4 milligrams of total THC per container under Public Law 119-37. The limit is per container so a larger bottle of the same extract carries more total THC than a smaller one. Each size therefore needs its own check with your counsel.

How do you protect a glass tincture bottle inside the carton?

A fitted insert is what protects it, and a die cut card cradle or a foam bed holds the bottle so it can't move inside the carton. A bottle that can't move won't chip at the shoulder, and we size the insert to the bottle we measure rather than a nominal volume.
