What Does MoCRA Put on a Cosmetic Box?
The Modernization of Cosmetics Regulation Act of 2022 changed what a cosmetic label has to carry and two of the changes land on the carton. By December 29, 2024 every cosmetic product label has to include a domestic address, a domestic phone number, or electronic contact information. That line is there so a customer can report an adverse event and a website address counts as electronic contact.
The second change came a year earlier than the first one. From December 29, 2023 a cosmetic sold for professional use has to state on the label that it’s for use only by licensed professionals. A salon lash adhesive or a professional nail lacquer carries that line on the carton and a retail version of the same product doesn’t.

The FDA exempts some small businesses from registration and listing. The exemption doesn’t cover products that contact the eye or are injected or ingested or alter appearance for more than 24 hours. Eyeliner and mascara and lash products sit inside that carve out so a small brand in the eye category registers like a large one.
Is Your Product a Cosmetic or a Drug?
The answer decides the panels and the FDA settles it on intended use rather than on the formula. A product that cleanses or beautifies or promotes attractiveness is a cosmetic. A product that claims to treat a condition or affect the structure or function of the body is a drug. A product that does both is regulated as both at the same time.
A hair oil that says it adds shine is a cosmetic and one that says it regrows hair is a drug. The second one carries a Drug Facts panel and the first one carries an ingredient list. The carton has to be laid out for whichever the claim makes it. We ask what the front panel is going to say before we draw a single fold.
