What Does the November 12, 2026 Rule Mean for a Display?
Congress narrowed the definition of hemp inside Public Law 119-37 and the change takes effect on November 12, 2026. The test moves from delta-9 THC alone to total THC including THCA. A finished product may carry no more than 0.4 milligrams of total THC per container. A product over that line is treated as a Schedule I controlled substance under the Controlled Substances Act.
A display doesn't change that count and it can't be used to average across units. Twelve compliant tincture bottles in a tray are twelve compliant containers. One 100 ml bottle over the line is over the line no matter what sits beside it. We ask which sizes go in the display before we cut the tray because that's where mixed sizes get slipped in.
Can a Display Box Carry a Health Claim on Its Header?
The header is the largest printed surface on the counter and the one a regulator reads first. The Food and Drug Administration said on January 26, 2023 that it doesn't intend to allow CBD in dietary supplements or conventional foods.
That position rules out a Supplement Facts panel on the units and rules out supplement style claims on the header above them. We lay out the header with the brand and the product name and the price and no health promise. We ask you to run the wording past counsel before the proof.
Is a CBD Display Box Child Resistant?
No, and no display is because the display stands open all day on a counter. Child resistance belongs to each unit inside it through a mechanism tested under 16 CFR 1700.20. That test uses 50 children aged 42 to 51 months and 100 adults aged 50 to 70.
