Why Does the Gummy Count Decide Whether the Box Is Legal?
Congress narrowed the definition of hemp inside Public Law 119-37 and the change lands on November 12, 2026. A finished hemp product may then carry no more than 0.4 milligrams of total THC per container. A product over that line is treated as a Schedule I controlled substance.
The word container is the whole story for gummies and it changes the pack size question entirely. Thirty gummies in one jar are one container and the limit covers all thirty together. A ten count pouch of the same gummy carries a third of the total so the pack size becomes a compliance decision before it becomes a marketing one.

Can a Gummies Box Look Like Candy?
Not like any candy a child already knows, and the federal agencies have been sending letters about it. On July 16, 2024 the Federal Trade Commission and the Food and Drug Administration wrote to five companies. Their THC edibles sat in packaging that copied cereal and candy brands. The companies had 15 days to respond and six others had received the same letters in July 2023.
The letters name the problem as packaging nearly identical to food children eat. That is the exact design brief many gummy brands bring us. We won’t build a carton that borrows a candy brand’s colors or its shape or a cartoon mascot.
What Belongs on a CBD Gummies Box?
The Food and Drug Administration said on January 26, 2023 that it doesn’t intend to allow CBD in conventional foods or dietary supplements. That rules out a Supplement Facts panel on a gummy carton and any claim that reads as a supplement claim on the front.
What does belong is the statement of identity and the net contents and the full ingredient list and your name and place of business. Add the count and the milligrams of CBD per gummy and the total per container. A batch or lot number goes on as well so a certificate of analysis ties to the jar.
Which Structure Fits a Jar, a Pouch, and a Single Gummy?
Edibles need child resistance that lasts the life of the product rather than only until the first opening. California draws that line clearly and puts edibles in the lifetime child resistant group. That means a jar needs a certified cap and a pouch needs a certified zipper. The test behind both is 16 CFR 1700.20 with 50 children and 100 adults.

The printed carton is never the child resistant part and we say that plainly. The certified cap or zipper carries the claim while our carton carries the brand.
