Why Does the Eye Area Have Its Own Color Rules?
FDA states that a number of color additives approved for cosmetic use in general are not approved for use in the area of the eye. Eyeliner sits inside that stricter group along with mascara and eye shadow.
Kohl is the clearest example of how that plays out. FDA has identified kohl and kajal and surma and similar materials as illegal color additives under section 201(t) of the Federal Food, Drug and Cosmetic Act. None of these materials appear anywhere in the color additive regulations. These materials often carry high levels of lead, and one tiro product tested at 82.6 percent lead. Products labeled as kohl or kajal or surma are subject to detention at US ports under Import Alert 130.
What Must an Eyeliner Carton Actually Say?
The carton is the labeled surface for a small cosmetic, because the pencil or pen itself has almost no printable area. Four separate elements have to fit onto that printed surface.

Since December 2024 a domestic address or a phone number or a website also has to appear so consumers can report adverse events. We lay these panels out on the dieline first, since a narrow eyeliner carton runs out of room quickly.
